ARTICLE 1.    GENERAL PROVISIONS
1.1    The Privacy Policy specifies how Users’ Personal Data necessary for the provision of services by electronic means via the website www.duerkopp-adler-polska.com (hereinafter:  Service) are collected, processed, and stored.
1.2    The Service collects only the Personal Data necessary for the provision and development of the services offered therein.
1.3    Personal Data collected via the Service is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter GDPR), as well as the Personal Data Protection Act of 10 May 2018.

ARTICLE 2.    DATA CONTROLLER
The controller of Personal Data collected through the Service is DAPS POLSKA spółka z ograniczoną odpowiedzialnością, with its registered office in Kąty Wrocławskie, ul. Nowowiejska 38, 55-080, entered in the Register of Entrepreneurs at the District Court for Wrocław-Fabryczna, 6th Commercial Division in Wrocław under KRS number 0000055799, with share capital of PLN 1,500,000.00, NIP 8990108219, REGON 930109790, email address: info@duerkopp-adler-polska.com (hereinafter: the Controller).  

ARTICLE 3.    PURPOSE OF PERSONAL DATA COLLECTION
3.1    Personal Data is used for the following purposes:
3.1.1    Communication with the User via the contact form.
3.1.2    Distribution of the newsletter (subject to the User's consent to receive it).
3.1.3    Provision of social services.
3.1.4    Promotion of the Administrator’s offer.
3.1.5    Marketing, remarketing, and affiliation.
3.1.6    Personalization of the Service for Users.
3.1.7    Analytical and statistical activities. 

3.2    Providing data is voluntary but necessary to use certain functionalities of the Service.

ARTICLE 4.    TYPE OF PERSONAL DATA PROCESSED
4.1    The Administrator may process the User’s Personal Data: name and surname, date of birth, residential address, e-mail address, telephone number, and NIP.
4.2    Retention period of Personal Data; Users’ Personal Data will be processed for the following period:
4.2.1        When the basis for data processing is the performance of a contract – until the limitation period for claims expires after its execution.
4.2.2        When the basis for data processing is consent – until it is withdrawn, and after withdrawal, until the limitation period for claims expires.
In both cases, the limitation period is 6 years, and for claims for periodic benefits and claims related to business operations – 3 years (unless a specific provision provides otherwise).

ARTICLE 5.    DISCLOSURE OF PERSONAL DATA
Users’ Personal Data may be transferred to: entities affiliated with the Controller, its subcontractors, entities cooperating with the Controller, e.g., companies providing e-payment services,  companies providing courier/postal services, and law firms.

ARTICLE 6.    USER RIGHTS
6.1    The User of the Service has the right to: access the content of their personal data, rectify, erase, restrict processing, transfer, object to processing, and withdraw consent at any time (without affecting the lawfulness of processing based on consent before its withdrawal). 
6.2    A notification regarding the exercise of the above-mentioned rights by the User should be sent to info@duerkopp-adler-polska.com.
6.3    The Administrator shall fulfill or refuse to fulfill the request without undue delay and in any case no later than one month from its receipt.
6.4    The User has the right to lodge a complaint with the President of the Personal Data Protection Office if they believe that the processing infringes their rights and freedoms (GDPR).

ARTICLE 7.    COOKIES
7.1    The Service collects information using cookies—session, persistent, and third-party cookies.
7.2    The collection of cookies supports the proper provision of services within the Service and serves statistical purposes.
7.3    The User may determine the scope of cookies' access to their device in the browser settings.

ARTICLE 8.    AUTOMATED DECISION-MAKING AND PROFILING
8.1    User datacannot be processed in an automated manner in such a way that any decisions could be made concerning them as a result.
8.2    User data may be subject to profiling for the purpose of content customization and offer personalization, following the User’s consent.

ARTICLE 9.    FINAL PROVISIONS
9.1    The Administrator reserves the right to introduce changes to the Privacy Policy, provided that the rights of Users are not restricted.
9.2    Information regarding any changes introduced will appear in the form of a notice available on the Service. 
9.3    In matters not governed by this Privacy Policy, the provisions of the GDPR and the provisions of Polish law shall apply.
